3. User Accounts and Registration

To access certain features of our Services, you may need to create an account. You agree to:

• Maintain and promptly update your account information to keep it accurate

6. AI Limitations and Disclaimers

LUMI uses artificial intelligence to provide language learning assistance. You acknowledge and understand that:

• AI-generated feedback and recommendations are for educational purposes only
• Our AI may occasionally provide inaccurate or inappropriate responses
• LUMI is not a replacement for formal language education or human instruction
• Results and progress may vary based on individual usage and learning style
• We do not guarantee specific learning outcomes or proficiency levels

7. Subscription and Payment

LUMI may offer both free and premium subscription plans. For paid services:

• All fees are due in advance and are non-refundable unless required by law
• Subscriptions automatically renew unless cancelled before the renewal date
• We may change pricing with 30 days' notice to existing subscribers
• You can cancel your subscription at any time through your account settings
• Refund requests will be considered on a case-by-case basis

8. Intellectual Property Rights

The Services, including all content, features, and functionality, are owned by UMO Inc. and are protected by intellectual property laws. This includes:

• The LUMI AI models, algorithms, and software
• All text, graphics, logos, and design elements
• Educational content and learning materials
• Trademarks, service marks, and trade names

You may not reproduce, distribute, modify, or create derivative works based on our intellectual property without explicit written permission.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. 10. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL UMO INC. BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless UMO Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Services, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account and access to the Services at any time, with or without cause, with or without notice. You may also terminate your account at any time by contacting us or using the account deletion feature in the Services.

Upon termination, your right to use the Services will immediately cease, and we may delete your account and all associated data. Provisions of these Terms that by their nature should survive termination will remain in effect.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if they qualify.
